The purpose of the BancWest Corporation ("BancWest", "we", "us" or "our") website ("Site") is to provide the public with information about our corporation and our subsidiaries. 

The Site does not offer products or services to the public.  The Site is only interactive to the extent that it allows visitors to:

• Submit questions or comments about our site;
• Request information.

This privacy policy ("Privacy Policy") describes how BancWest handles the information that consumers may provide to us when visiting the Site (http://www.bancwestcorp.com) or when contacting us by postal mail, telephone, e-mail or through the Site. 

COLLECTION OF INFORMATION

BancWest will only collect personally-identifiable contact information that you voluntarily provide if you call us, write to us, send us e-mails or transmit information via the Site.  By doing any of the foregoing, or otherwise using the Site, you assent to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not engage in any of these activities.

Personally-identifiable information that we collect may include your name, street address, e-mail address, and phone number.  Remember that e-mail communications are not necessarily secure against interception so please do not include sensitive information like your Social Security number in your e-mail communications with us. 

In addition to the information described above, when you visit the Site our systems log the web pages that you visit. This information may be used to analyze trends, administer the Site, improve the design of the Site, track user movement, and otherwise enhance the services we provide.

Additionally, the Site collects aggregate site-wide information, including anonymous site statistics.

USE OF INFORMATION

If you choose to provide personally identifying information to us, we use it only to respond to or refer your comments or requests and to better enhance our services.  We do not share your information with telemarketers.  BancWest may keep a record of your contact with us as necessary to comply with industry record-retention requirements.  We take steps to maintain the security and confidentiality of your personally identifying information while it is in our possession.   Unfortunately, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

We will only provide non-personally identifiable aggregate data, such as the number of users who have visited the Site, to affliates of BancWest and other companies for use in the marketing and promotion of BancWest.

We will comply with any subpoenas, court orders or other legal processes for any of the information about you in our possession, and we may use such information to establish or exercise our legal rights, or to defend against legal claims. We also reserve the right to disclose information about you to third parties if we feel it is necessary to protect our systems, business, users or others.

Information about you in our possession may also be disclosed as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which your personal information would be transferred as one of the business assets of the company. BancWest does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this Privacy Policy.

Notwithstanding anything contained herein, we will disclose non-personally identifiable information to other companies that we contract with to create, support, manage, maintain or improve the Site.

OTHER WEBSITES

For your convenience, the Site contains links to other websites, or you may be otherwise referred to other websites, including websites administered by BancWest or companies affiliated with BancWest, as well as to websites unaffiliated with BancWest. This Privacy Policy does not apply to any of these websites. Once you access another website, you are subject to the privacy policy of that site.

CHILDREN’S PRIVACY

If you are under the age of 13, please do not use or access the Site in any way. We will not knowingly collect or use any personal information from such children under the age of 13. If we become aware that we have collected any personal information from children under 13, we will promptly delete such information from our databases.

CHANGES TO THIS POLICY

BancWest may update this Privacy Policy from time to time. In the event that BancWest merges with, or is acquired by, another company, a change to this Privacy Policy may result. Whenever a change to this Privacy Policy is significant, we will place a prominent notice on the Site.

GOVERNING LAW

By choosing to visit this Site or otherwise provide information to BancWest, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the State of California. You also agree to abide by any limitation on damages contained in our Terms of Use (available at www.bancwestcorp.com) or other agreement we have with you.
